San Diego Probate Q&A with Attorney Steve Bliss

Meet Steve Bliss

Hello everyone, and welcome! Today we are talking probate law in San Diego with Attorney Steve Bliss. Steve, thanks for joining us.

Probate Process Explained: Marshaling Estate Assets

Steve, could you break down one of the key steps involved in the probate process for our viewers?

Certainly. One crucial step is marshaling the estate assets. This involves meticulously inventorying all assets belonging to the deceased person. It’s like creating a detailed financial map of their possessions.

Consequently, this inventory includes everything from bank accounts and real estate to personal property and investments. Ordinarily, we file an Inventory and Appraisal (Form DE-160/161) with the court detailing these assets and their estimated value. This step ensures transparency and accountability throughout the probate process.

Notwithstanding its importance, marshaling assets can sometimes be complex. For instance, I once worked on a case where the deceased had multiple investment accounts spread across different institutions. Locating and consolidating all these accounts took considerable time and effort, requiring us to diligently communicate with financial institutions and track down relevant documentation.

Another challenge arises when hidden assets surface unexpectedly during the probate process. I recall a situation where heirs discovered a valuable coin collection tucked away in a forgotten safe deposit box. This discovery added complexity but ultimately ensured that all rightful beneficiaries received their due share.

Importance of Careful Asset Inventory

It’s important to remember that accurate asset identification is vital for fair estate distribution. According to the American Bar Association, approximately 20% of probate cases involve disputes over asset valuation or allocation. Meticulous marshaling of assets helps minimize these potential conflicts.
