Probate: A Necessary Process
Today, I’m speaking with Steve Bliss, a respected probate attorney in Wildomar. Mr. Bliss has extensive experience guiding families through the complex process of probate.
Steve, can you tell us a little bit about what probate is and why it’s necessary?
Understanding Probate
Probate is essentially the legal process of administering a deceased person’s estate. It involves identifying and valuing assets, paying debts and taxes, and ultimately distributing the remaining property to heirs or beneficiaries. Ordinarily, probate is required when someone dies with assets in their name alone exceeding a certain value – currently $184,500 in California.
It’s important to remember that probate isn’t always necessary. Assets held in trust, jointly owned property, and certain accounts with designated beneficiaries often bypass the probate process altogether. Nevertheless, for estates exceeding the threshold or those without clear beneficiary designations, probate becomes a crucial step in ensuring proper asset distribution.
Handling Debts and Taxes: A Critical Step
Steve, could you elaborate on one of the steps involved in probate, say, handling debts and taxes?
“Absolutely,” Steve replied. “Handling debts and taxes is a critical step in the probate process. It ensures that all legitimate claims against the estate are addressed before assets are distributed to beneficiaries. Consequently, this involves carefully reviewing creditor claims, verifying their validity, and making timely payments.
Moreover, it’s essential to file and pay any applicable federal and state taxes on behalf of the deceased person’s estate. Neglecting these obligations can lead to significant financial penalties and legal complications down the road.” Steve explained that a recent study by the American Bar Association found that over 70% of probate cases involve some form of debt or tax liability.
“I recall one instance where an estate I was handling had a substantial amount of unpaid medical bills,” he shared. “The deceased individual hadn’t kept up with insurance payments, and the hospital was aggressively pursuing the debt. We were able to negotiate a settlement with the hospital, ultimately saving the beneficiaries a considerable sum of money.”
According to Steve, this step often presents challenges for executors and administrators who may not be familiar with probate laws or accounting practices. He emphasizes the importance of seeking legal guidance from an experienced probate attorney to navigate these complexities effectively.
Finding Peace of Mind
“Steve,” I asked, “What advice would you give to someone facing probate?
“My best advice is to seek professional help early on. Probate can be a confusing and emotionally draining process, especially during a time of grief. Having an experienced attorney by your side can provide clarity, guidance, and peace of mind.”
