It’s about taking control of your affairs *now*, ensuring your wishes are honored, and protecting your loved ones. The first step, ‘A’ as we outline it, is identifying your goals and priorities. This isn’t just about the financial aspect; it’s about your values, your family dynamics, and what you want your legacy to be.

Next, we move into gathering and organizing all your personal and financial information – bank accounts, real estate, investments, insurance policies. It seems tedious, but trust me, it’s incredibly valuable when it comes time to put the plan in motion. Then, you need to choose key people – your executor, your guardian for minor children, your power of attorney, and your healthcare agent. These are the people you trust to carry out your wishes, so choose wisely.

Creating the core documents – your will, trust, power of attorney, and healthcare directive – is where things become more formal. This is where legal expertise becomes crucial. Absolutely, Amelia. Step ‘H’—Organizing and Storing Your Documents—often gets overlooked, but it’s surprisingly critical. You’ve gone through all the effort of creating a comprehensive estate plan; you need to ensure those documents are readily accessible when needed. Think of it like a treasure map; having the map is useless if you can’t find it!

The first thing I recommend is a secure, yet accessible, location. A fireproof safe is a good start, but it’s not enough. Many people choose to keep the originals in a bank safety deposit box, but there can be challenges accessing those after death. I often advise clients to keep the originals at my office – Point Loma Estate Planning APC – where they are securely stored and readily available to authorized individuals.

Regardless of where you store the originals, make sure your executor, trustee, and healthcare agent have copies. A digital backup is also a great idea – encrypted cloud storage is a good option. A checklist or summary of your plan, outlining where everything is located, is also invaluable. It’s not enough to simply say, “It’s in the safe.” Be specific: “The original will is in the top drawer of the safe, behind the insurance policies.”

Oh, absolutely. You wouldn’t believe how often we encounter situations where clients have meticulously crafted estate plans, but the documents are hidden away in obscure locations, or there’s no clear indication of where to find them. I once had a client who stored their will inside a vintage teapot—a lovely teapot, but not exactly conducive to quick access during an emergency!

Another common issue is outdated information. People move, remarry, have children, and their estate plans need to be updated accordingly. We’ve seen cases where beneficiaries listed in a will have already passed away, creating legal complications. It really highlights the importance of regular review and updating. It is not a “set it and forget it” process, as life happens!

More recently, we dealt with a situation where a client had digital assets—cryptocurrency—but hadn’t left any instructions for accessing them. The family spent months trying to recover the funds, incurring significant legal fees. It just underscores the importance of addressing digital assets in your estate plan.

About Estate Planning Law – Ted Cook

Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
