Interview with Steve Bliss, San Diego Probate Attorney
Hi Steve, thanks for taking the time to talk with me today.
It’s my pleasure. I always enjoy helping people understand the probate process.
Handling Debts and Taxes: A Crucial Step
Steve, could you tell us a little about the step of handling debts and taxes during probate?
Certainly. This is a crucial stage in any probate proceeding. Ordinarily, before we can distribute assets to beneficiaries, we need to settle all outstanding debts and obligations owed by the deceased.
This process involves identifying and verifying all valid creditor claims. It’s important to note that only legitimate claims with proper documentation are considered. We meticulously review each claim to ensure its validity. Consequently, we may challenge claims that lack sufficient evidence or appear fraudulent.
In addition to handling debts, we must also address any tax liabilities incurred by the deceased. This includes both federal and state estate taxes. The amount owed will depend on various factors, such as the size of the estate and applicable tax laws. We work closely with qualified tax professionals to accurately calculate and file all necessary returns.
Notwithstanding these complexities, it’s a process we handle diligently to ensure everything is done correctly and ethically. A recent study by the American Bar Association found that 75% of probate cases involve some level of debt resolution. This highlights the importance of having an experienced attorney who understands the intricacies of this step.
Navigating Challenges: Real-World Examples
Have you ever encountered any unique challenges during this phase?
There was a case I remember where a family member presented a handwritten note claiming the deceased owed them a substantial sum. It lacked any formal documentation or supporting evidence. After carefully reviewing the circumstances and consulting with other parties, we ultimately determined that the claim wasn’t valid.
Conversely, I’ve also seen situations where the deceased had made charitable pledges that needed to be honored through their estate. In those instances, it’s fulfilling to help carry out their final wishes.
The Importance of Legal Expertise
Clearly, navigating debt and tax matters in probate requires expertise and attention to detail.
Absolutely. Mistakes in this stage can have significant financial repercussions for beneficiaries. It’s essential to work with a qualified attorney who understands the legal nuances involved and can guide you through the process effectively.
Empowering Families Through Probate
What do you consider the most rewarding part of your work?
“Seeing families navigate this difficult time with clarity and peace of mind. Knowing we’ve helped them honor their loved one’s wishes and secure their financial future is incredibly fulfilling.”
